What Tahkeem is
Tahkeem — the Sharjah International Commercial Arbitration Centre — is the principal arbitration institution for Sharjah-domiciled commercial disputes and Northern Emirates matters. Established under the Sharjah Chamber of Commerce, Tahkeem administers arbitrations under its own institutional rules with awards enforceable internationally under the New York Convention 1958.
Why Tahkeem matters
For Sharjah-headquartered industrial groups, manufacturing-zone counterparties, F&B and consumer-goods supply disputes, and Northern Emirates real-estate matters where parties want institutional arbitration without the cost of DIAC, Tahkeem offers a credible, increasingly modern arbitration framework. The Tahkeem panel has deep experience with the manufacturing, packaging, F&B and real-estate sectors that dominate the Sharjah commercial economy.
The Tahkeem process
Notice → Response → Tribunal constitution → pleadings → evidentiary hearing → award → enforcement. Awards typically run 10-18 months. Bilingual EN/AR.
What a Tahkeem arbitration costs
Tahkeem applies the structure common to the UAE institutions: a fixed registration fee on filing, then administrative and tribunal fees calculated from the amount in dispute. Its cost base is competitive for the Sharjah market, which together with proximity is the main reason parties select it.
The number of arbitrators remains the largest controllable cost, and the rules' default turns on what the arbitration agreement says. A sole arbitrator is right for most mid-value commercial disputes; a three-member tribunal earns its cost where the sums or the technical complexity justify it. The costs parties do not plan for are procedural — document production and interlocutory applications — and they are within the parties' control in a way the institution's schedule is not.
Costs ordinarily follow the event, and the tribunal may award legal costs alongside the costs of the arbitration.
| Cost element | Basis | Practical note |
|---|---|---|
| Registration fee | Fixed, on filing | Non-refundable, paid with the request |
| Administrative fee | Ad valorem on the amount in dispute | Scaled, capped at the top of the band |
| Tribunal fees | Ad valorem, per arbitrator | Sole vs three-member is the main lever |
| Expedited track | Reduced scale | Where the rules and the sum in dispute allow |
| Legal costs | As incurred | Recoverable; costs ordinarily follow the event |

When Tahkeem is the right forum
Tahkeem is the natural forum for disputes anchored in Sharjah: contracts performed in the emirate, parties established there, or assets there against which enforcement will ultimately be sought. Sharjah's industrial and manufacturing base means a significant share of its caseload is supply, construction and distribution work, and local familiarity with those sectors is a practical advantage.
Against that, an international counterparty may prefer a forum it recognises, and a dispute likely to turn on questions where a deeper body of published authority would assist may be better served by a DIFC or ADGM seat. The realistic comparison for most Sharjah parties is Tahkeem against DIAC: Tahkeem for proximity and cost, DIAC for profile and the depth of practice around it. Either way the decision belongs at drafting, when it can still be made deliberately.
