The Kuwait Commercial Arbitration Center administers institutional arbitration under the Kuwait Chamber of Commerce and Industry. Its distinguishing feature is a gap-filler that most institutions do not have: where the KCAC Rules are silent, the UNCITRAL Arbitration Rules apply.
What the KCAC is
Institutional arbitration in Kuwait runs through the KCAC, operating under the Kuwait Chamber of Commerce and Industry and applying its own rules. Global Arbitration Review reports that the Centre introduced new arbitration rules in 2024 aimed at efficiency and transparency; we have not been able to confirm the effective date on a KCAC source, so check the current edition before drafting to it.
A separate body, the Kuwait Society of Engineers' centre for mediation and arbitration, also administers cases — principally construction. Make sure a clause names the one you mean.
The UNCITRAL fallback
Article 7 of the KCAC Rules provides that where the Rules are silent on an issue, the UNCITRAL Arbitration Rules apply by default.
This is genuinely useful rather than a technicality. Institutional rule sets are necessarily incomplete, and the usual answer to a gap is tribunal discretion, which is unpredictable. Here the gap is filled by a rule set that is published, widely litigated and familiar to any international practitioner. In practice it means you can advise on a procedural question with more confidence than the length of the KCAC Rules alone would suggest.
The legal framework and the 2024-25 shift
Kuwait's general arbitration law sits in the Civil and Commercial Procedure Law, Law No. 38 of 1980, Articles 173 to 188, with sector-specific regimes alongside it.
The live point is judicial rather than legislative. Global Arbitration Review reports that in a run of decisions across 2024 and 2025 the Kuwaiti courts redrew the boundaries of arbitration. Where a Kuwaiti seat or Kuwaiti enforcement is in contemplation, the current state of that case law is a question to put to Kuwaiti counsel on the specific clause — not something to take from a guide, including this one.
When the KCAC is the right forum
It is the natural institutional choice where the counterparty and the assets are Kuwaiti and a domestic award is worth more to you than a neutral seat. The UNCITRAL fallback makes the procedure more predictable than the institution's profile suggests.
Where the counterparty is Kuwaiti but the assets are not, or where the 2024-25 case law bears on your clause, a neutral regional seat with a clean enforcement path may serve you better — our seat selection matrix sets out the comparison.
Frequently asked questions
What rules govern a KCAC arbitration?
The KCAC's own rules, applied under the Kuwait Chamber of Commerce and Industry. Article 7 provides that where the KCAC Rules are silent, the UNCITRAL Arbitration Rules apply by default. Global Arbitration Review reports that new KCAC rules were introduced in 2024; we have not confirmed the effective date on a KCAC source, so verify the current edition before drafting to it.
What is Kuwait's arbitration law?
The general framework is in the Civil and Commercial Procedure Law, Law No. 38 of 1980, Articles 173 to 188, with sector-specific regimes alongside it.
Has Kuwaiti arbitration law changed recently?
The significant movement has been judicial rather than legislative. Global Arbitration Review reports a run of Kuwaiti court decisions across 2024 and 2025 that redrew the boundaries of arbitration. If a Kuwaiti seat or Kuwaiti enforcement is in contemplation, take advice on the current state of that case law against your specific clause.
Is the KCAC the only arbitration centre in Kuwait?
No. The Kuwait Society of Engineers also operates a centre for mediation and arbitration, used principally for construction disputes. A clause should name the intended institution precisely.
Matter on your desk?
We act for claimants and respondents in GCC-seated arbitration, and as co-counsel with local firms where the seat requires it. If a contract on your desk names one of these institutions — or you are deciding which to name — send us the clause and a partner will come back on forum, enforceability and the realistic cost.
