The Bahrain Chamber for Dispute Resolution does two quite different things, and conflating them is the usual mistake. It administers consensual arbitration under its 2022 Rules. It also houses the BCDR Court, which takes statutory jurisdiction over large Bahraini commercial claims whether or not anyone agreed to arbitrate.
What the BCDR is
The BCDR was established by Legislative Decree No. 30 of 2009, amended by Legislative Decree No. 64 of 2014 and Legislative Decree No. 26 of 2021.
It began as a partnership with the American Arbitration Association and traded as BCDR-AAA. That partnership was brought to an amicable close in 2022 by mutual agreement. The institution is now simply the Bahrain Chamber for Dispute Resolution, and its site moved from bcdr-aaa.org to bcdr.org. Contracts and precedent clauses drafted before 2022 that name "BCDR-AAA" are referring to this institution, but the name no longer exists — worth correcting on any clause you are refreshing.
The BCDR Court: jurisdiction without an agreement
This is the feature that has no equivalent elsewhere in the GCC, and the one to check before advising a Bahraini counterparty that litigation is the default.
The BCDR Court can hear disputes that would otherwise go to the Bahraini courts where the claim exceeds BHD 500,000 (roughly US$1.3 million) and any of the following holds:
- at least one party is a financial institution licensed by the Central Bank of Bahrain; or
- both parties are companies licensed under the Commercial Companies Law (Decree No. 21 of 2001); or
- the dispute is international and commercial.
Two further heads sit alongside it: real estate disputes above BHD 500,000 involving specified property arrangements, under Law No. 22 of 2017; and trust disputes under Legislative Decree No. 23 of 2016.
The practical consequence: a substantial Bahraini commercial dispute involving a licensed bank or two licensed companies may be heard by the BCDR Court with no arbitration clause anywhere in the contract. If you are drafting, decide deliberately whether you want that forum or want to contract around it; if you are already in dispute, establish which forum has jurisdiction before filing anywhere.
The 2022 Arbitration Rules
BCDR's consensual arbitration runs under its Rules of Arbitration, which came into effect in 2022, superseding the 2017 and 2010 editions. The institution also maintains separate 2022 Sports Arbitration Rules.
Check which edition your clause incorporates. A clause drafted in, say, 2018 that refers to "the BCDR-AAA Arbitration Rules" will ordinarily pick up the rules in force when proceedings commence, but the point is worth settling early rather than arguing about it at the constitution stage.
When the BCDR is the right forum
It is the obvious forum where the counterparty is a Bahraini licensed entity or a CBB-regulated financial institution, and where the claim is large enough to engage the BCDR Court in any event — in that situation choosing BCDR arbitration is choosing the procedure, not choosing whether to be there at all.
It is also a credible neutral regional seat for Gulf financial-services disputes, with a bench and a rule set built for them. Where the assets to execute against are outside Bahrain, work the enforcement question separately — see our enforcement and recovery atlas.
Frequently asked questions
Is BCDR still BCDR-AAA?
No. BCDR began in partnership with the American Arbitration Association and traded as BCDR-AAA, but that partnership was brought to an amicable close in 2022 by mutual agreement. The institution is now the Bahrain Chamber for Dispute Resolution and its website is bcdr.org; the former bcdr-aaa.org address redirects there. Clauses naming "BCDR-AAA" refer to this institution under a name it no longer uses.
Can the BCDR hear my case without an arbitration agreement?
Yes, in defined circumstances. The BCDR Court takes jurisdiction over disputes that would otherwise fall to the Bahraini courts where the claim exceeds BHD 500,000 and either at least one party is a Central Bank of Bahrain-licensed financial institution, or both parties are companies licensed under the Commercial Companies Law (Decree No. 21 of 2001), or the dispute is international and commercial. Real estate disputes above BHD 500,000 under Law No. 22 of 2017 and trust disputes under Legislative Decree No. 23 of 2016 also fall within it.
What law established the BCDR?
Legislative Decree No. 30 of 2009, as amended by Legislative Decree No. 64 of 2014 and Legislative Decree No. 26 of 2021.
Which BCDR arbitration rules apply?
The Rules of Arbitration that came into effect in 2022, superseding the 2017 and 2010 editions. BCDR also maintains separate 2022 Sports Arbitration Rules. Where a clause incorporates the rules generally, the edition in force when proceedings commence will ordinarily apply — settle the point early.
Matter on your desk?
We act for claimants and respondents in GCC-seated arbitration, and as co-counsel with local firms where the seat requires it. If a contract on your desk names one of these institutions — or you are deciding which to name — send us the clause and a partner will come back on forum, enforceability and the realistic cost.
