What arbitrateAD is

The Abu Dhabi Commercial Conciliation and Arbitration Centre (arbitrateAD) is Abu Dhabi's principal commercial arbitration institution. Established by the Abu Dhabi Chamber of Commerce, arbitrateAD administers commercial arbitrations seated in Abu Dhabi under its own institutional rules. Awards are enforceable internationally under the New York Convention 1958.

Why arbitrateAD matters

For matters involving Abu Dhabi-domiciled commercial counterparties, ADNOC supply chain participants, sovereign-linked entities (ADQ portfolio, Mubadala portfolio, ADIA-related transactions), and capital-investment disputes in the emirate, arbitrateAD is frequently the contractually-specified arbitration seat. The arbitrateAD panel has deep experience with energy, construction and supply-chain disputes characteristic of the Abu Dhabi commercial environment.

The arbitrateAD process

The procedural framework mirrors international commercial arbitration practice: Notice of Arbitration → Response → Tribunal constitution → Statement of Claim & Defence → Evidentiary hearing → Award → Enforcement. arbitrateAD awards typically run 10-18 months from filing. Bilingual EN/AR proceedings.

arbitrateAD vs DIAC

For Abu Dhabi-centric matters where the counterparty is Abu Dhabi-domiciled and the assets are in Abu Dhabi, arbitrateAD is the natural choice. For matters with broader UAE or international dimensions, DIAC may offer a more developed institutional framework after the 2022 reforms. We advise on the choice at clause-drafting stage.

What an arbitrateAD arbitration costs

arbitrateAD charges on an ad valorem basis: a fixed registration fee on filing, then an administrative fee and tribunal fees scaled to the amount in dispute. The practical consequence is that the institution is highly competitive at the lower and middle of the range and converges with the international institutions as the sum in dispute rises.

The largest controllable cost is the size of the tribunal. A three-member tribunal is the right answer for a substantial or technically contested reference and the wrong one for a straightforward payment claim, and the default under the rules depends on what the clause provides — which is a drafting decision made years before anyone knows the value of the dispute. Beyond that, the costs that surprise parties are almost always self-inflicted: document production disputes, interlocutory applications and late amendments are all chargeable, and all foreseeable.

Costs ordinarily follow the event, and the tribunal can award legal costs as well as the costs of the arbitration. An unsuccessful party should expect to contribute to the other side's fees.

When to choose arbitrateAD, and the seat question

arbitrateAD is the natural choice where the parties, the performance and the assets are in Abu Dhabi. Proximity is not a trivial advantage: hearings, witnesses and enforcement all sit in the same emirate, and the institution's rules were modernised to align with international practice, so choosing locally no longer means accepting a dated procedural framework.

The choice that deserves separate thought is the seat. An Abu Dhabi seat puts the onshore courts in the supervisory role; an ADGM seat puts the ADGM Courts there instead, applying English common law and equity in English. That decision governs challenges to the award, applications for interim relief in support of the arbitration, and the procedural culture the parties will encounter if anything goes to court. It is entirely separate from the choice of institution, and clauses regularly conflate the two.

A contract forming part of a suite should carry compatible arbitration provisions across that suite — same institution, same seat, same language — or consolidation will be unavailable at exactly the moment a chain of related disputes makes it necessary.
